Britain, France and Germany to Keep Nuclear, Missile Sanctions on Iran


Britain, France and Germany announced Thursday they will keep their sanctions on Iran related to the Mideast country’s atomic program and development of ballistic missiles. The measures were to expire in October under a timetable spelled out in the now defunct nuclear deal between Tehran and world powers.

In a joint statement, the three European allies known as E3 and which had helped negotiate the nuclear deal, said they would retain their sanctions in a “direct response to Iran’s consistent and severe non-compliance” with the accord, also known by its official name as Joint Comprehensive Plan of Action or JCPOA.

The measures ban Iran from developing ballistic missiles capable of delivering nuclear weapons and bar anyone from buying, selling or transferring drones and missiles to and from Iran. They also include an asset freeze for several Iranian individuals and entities involved in the nuclear and ballistic missile program.

Iran has violated the sanctions by developing and testing ballistic missiles and sending drones to Russia for its war on Ukraine.

The sanctions will remain in place until Tehran “is fully compliant” with the deal, the E3 said. The sanctions, according to the accord from eight years ago, were to expire Oct. 18.

Iran’s Foreign Ministry called the European decision an “illegal, provocative action” that will hamper cooperation, in comments quoted by the country’s official news agency IRNA.

“The actions of the European parties will definitely have negative effects on the efforts to manage the tension and create a suitable environment for more cooperation between the JCPOA parties,” the ministry said.

The 2015 nuclear deal was meant to ensure that Iran could not develop atomic weapons. Under the accord, Tehran agreed to limit enrichment of uranium to levels necessary for nuclear power in exchange for the lifting of economic sanctions.

In 2018, then-President Donald Trump unilaterally pulled the United States out of the accord, saying he would negotiate a stronger deal, but that did not happen. Iran began breaking the terms a year later and is now enriching uranium to nearly weapons-grade levels, according to a report by the United Nations’ nuclear watchdog.

Formal talks to try to find a roadmap to restart the deal collapsed in August 2022.

The E3 have informed the European Union’s foreign policy chief, Josep Borrell, about their decision, the statement said. Borrell, in turn, said he had forwarded the E3 letter to other signatories of the 2015 deal — China, Russia and Iran.

The development comes at a delicate moment as the United States is preparing to finalize a prisoner swap with Iran that would include the unfreezing of Iranian assets held in South Korean banks worth $6 billion.

Iran’s mission to the United Nations did not immediately respond to a request for comment.

U.S. State Department spokesperson Matthew Miller told reporters that Washington was in touch with the European allies over “the appropriate next steps.”

“We are working closely with our European allies, including members, of course, of the E3, to address the continued threat that Iran poses including on missiles and arms transfers with the extensive range of unilateral and multilateral tools that are at our disposal,” he said.

Iran has long denied ever seeking nuclear weapons and continues to insist that its program is entirely for peaceful purposes, though Rafael Mariano Grossi of the International Atomic Energy Agency, the U.N. nuclear watchdog, has warned that Tehran has enough enriched uranium for “several” nuclear bombs if it chose to build them.

Under the terms of the nuclear deal, a U.N. arms embargo against Tehran will expire on Oct. 18, after which countries that do not adopt similar sanctions on their own as the E3 — likely Russia and perhaps also China — will no longer be bound by the U.N. restrictions on Iran.

However, Iran has lately slowed the pace at which it is enriching uranium, according to a report by the IAEA that was seen by The Associated Press earlier this month. That could be a sign Tehran is trying to ease tensions after years of strain between it and the U.S.

“The decision makes sense,” Henry Rome, an analyst with the Washington Institute for Near East Policy, said of the European decision. “The real question is how Iran will react. Given the broader de-escalation efforts under way, I would expect Iran not to act rashly, but we never know.”

 Senator Menendez Presses State Department on Its Actions Regarding Lachin Blockade, Assembly Submits Testimony

“Is it so important to us that we cozy up to someone who is in the process of creating ethnic cleansing? Is that the side of history the US wants to stand on?” concluded Senator Menendez.

Conveying the extent of bipartisan concern over the humanitarian crisis, Ranking Member Senator Jim Risch (R-ID) stated in his opening remarks that “tensions are rising again between Armenia and Azerbaijan” and that “ending this conflict would bring peace to a fractured region.”

“The US, along with our European allies, have an important role to play in the future of the Caucasus. Our action in response to the crisis in Nagorno-Karabakh will be key to broader US policy towards the region.”

In her opening statement, Assistant Secretary Kim said that the State Department shares Senator Menendez’s “sense of urgency.”

“We are deeply concerned by the continued closure of the Lachin Corridor and the impacts this closure is having on the people of Nagorno-Karabakh,” said Kim. She emphasized that the State Department views the “status quo as completely unacceptable” and that they will “not stop working until we have a resolution.”

“We have consistently said that that Corridor must be open to commercial, humanitarian, and private traffic,” she continued. “We have conveyed that message both publicly and privately to all levels of government in Azerbaijan on numerous occasions. Access to food, medicine, baby formula, and energy should never be held hostage.”

Kim stated that there should be no more delays and that it’s “essential for these supplies which have been ready to move in weeks to finally be delivered to the people of Nagorno-Karabakh now.”

She continued that the State Department is encouraging “all sides to work constructively” as the “only path forward is through dialogue.” Kim added: “We believe peace between Armenia and Azerbaijan would have cascading benefits for the region.”

Assistant Secretary Kim also said that “we have made clear that the rights and security of ethnic Armenians in Nagorno-Karabakh must be protected. This is an essential element of any durable and dignified peace agreement.”

Concluding her statement, Kim said that the US will not support any effort or action to “ethnically cleanse or commit other atrocities against the Armenian people of Nagorno-Karabakh,” reiterating that the “current humanitarian situation is not acceptable.”

Senator Menendez asked Kim if she shared his and the International Court of Justice’s (ICJ) assessment that the blockade presents a real and imminent risk to the health and life of Armenians, to which she agreed and again stated that the State Department shares his sense of urgency.

He then countered by asking what the State Department is doing to avert Azerbaijan’s military escalation, to which Kim responded that the US will not tolerate an attack on the people of Nagorno-Karabakh. Senator Menendez pointed out that Azerbaijan is not abiding by the 2020 ceasefire agreement and that “we are just asking them to live up to their agreements.” By not doing so, Senator Menendez observed that the US has “only emboldened Aliyev.”

Senator Pete Ricketts (R-NE) observed that Armenia prioritized its relationship with Russia militarily and economically “mainly because it’s the only game in town for security in Nagorno-Karabakh.”

Senator Ben Cardin (D-MD) said he agreed with Senator Menendez that the “humanity crisis is horrible” and each day that the US waits, “more people are dying.”

“The US needs to take decisive action,” he stated. “When you routinely give waivers under Section 907, you’re saying that Azerbaijan has demonstrated steps to cease all blockades and uses of force against Armenia and that’s just not the case, so we lose credibility when that happens when we aren’t prepared to take decisive steps based on our values.” He asked Kim why the waiver continues to be exercised since it sends the wrong message.

Assistant Secretary Kim responded that President Biden and Secretary Blinken have “made clear that human rights and values are at the center of our foreign policy.” She stated that “none of the assistance” the State Department provides is used for “offensive action against Armenia and it’s in the national security interest.” Kim said that the State Department continues to carefully review Section 907.

Senator Chris Murphy said that “gentle diplomacy” does not seem to be effective when dealing with President Aliyev. He concluded that while distancing itself from Russia, the US is “turning from dependence on one dictatorship to a different dictatorship and the question now becomes are we funding Azerbaijan’s efforts to impose a brutal blockade on the Armenian people.”

Senator Chris Van Hollen (D-MD) also raised concerns about Section 907 and asked Kim if US assistance was having a positive impact on the negotiations between Armenia and Azerbaijan, and the region as a whole. Kim responded that the Statement Department is going “through those issues very thoroughly.”

“I hope you don’t exercise the waiver because I don’t think the conditions on the ground merit it,” noted Senator Van Hollen.

Senator Menendez wrapped up the hearing by elaborating on the US’s values and principles. The Assembly’s testimony was also included for the record.

“If there is a country in the world that stands for human rights it’s the US,” he said. “Speaking of it [human rights] is meaningless. It’s a hollow promise without action.”

Earlier this week Senator Menendez delivered a speech on the Senate Floor where he said that the US “can’t look away at a systematic attempt to eradicate and erase an entire people from the face of the Earth…We must stop [Aliyev] from starving these Armenians to death.”

In the Assembly’s testimony, Executive Director Bryan Ardouny noted the hearing’s “critical timing” as the Armenian people are “now confronted with genocide and ethnic cleansing from their ancestral lands for the second time in little over a century.”

The testimony referenced the ICJ’s ruling to open the Lachin Corridor as Azerbaijan continues to “starve the Armenian people living in Nagorno-Karabakh, going so far as to deny even access to the International Committee of the Red Cross (ICRC), as well as the governments of Armenia and France, all of which have tried to deliver humanitarian supplies via the Lachin Corridor to the people of Artsakh.”

The Assembly reiterated its call for USAID to deliver aid directly to Stepanakert and urged “the Administration to use the considerable tools at its disposal not only to end the humanitarian crisis, but also help stop a genocide,” and can start by enforcing, and not waiving Section 907 of the Freedom Support Act.

“History has shown that appeasing dictators only serves to embolden them. President Biden has repeatedly said in his State of the Union addresses that the United States must stand in defense of democracies in the face of autocrats who want nothing more than to see democracy fail. The US has taken a strong stand in support of democracy in Ukraine and should do so for Artsakh and Armenia.”

“The Assembly’s position is clear,” concluded Ardouny in the Assembly’s testimony. “Stand up for democracy and human rights, oppose genocide and end the blockade of Artsakh.”

In Derna, the city on the coast of Libya all but swept away by flooding on Sept. 11, the surging complexities of climate change combined to devastating effect with the stubborn realities of fractious politics. The 11,300 people who three days later were known to be dead—and however many join the toll from the 10,000 listed as missing—may, officially, be recorded as victims of a natural disaster, the kind of immutable force referred to in courtrooms and insurance policies as an act of God.

But if anything is clear in the last days of the incendiary summer of 2023, it’s that human decisions factored in every life lost.

Consider Storm Daniel. Oceans produce hurricanes, but depressions in the Mediterranean Sea can create storms ferocious enough to be named. And as global warming drives sea temperatures to rise to astonishing levels, these medicanes (Mediterranean hurricanes) are holding ever more immense amounts of water. Before coming to Libya, Daniel dropped two feet of rain on parts of Greece on Sept. 5 and 6—as much as the region usually sees in 18 months. Then it swung west, and south, then, at the last moment, west again, loading up on moisture as it went.

On Sunday, it reached Libya. On maps, the country still appears as a single nation, but since 2014 it has existed as shards. Some of the pieces are governed by a warlord, others by a “government of national accord” that is recognized by international bodies but whose remit ends a few hundred miles from Tripoli, the capital.

It’s never good to be in a failed state, but it’s even worse to be in a failed state during the Anthropocene epoch, earth’s current geological era defined by man’s unnatural impact on the environment.

It was worst of all to be in Derna. The city of 100,000 is located on the coast where it juts into the Mediterranean, down which Daniel was barreling. Nine years ago, as Libya descended into civil war, Derna was taken by ISIS. It’s now under the control of Khalifa Hiftar, a septuagenarian warlord who drove the terrorist group out by laying siege to the city, starving its residents as well.

The invader this time was water. At first it came from two directions—storm surge from the sea and rain from above. Then, 13 miles above the city, a dam gave way. The wall of water that reached the city was 20 feet high. What it left is what we see here.

The nationalist Chinese newspaper Global Times described as “excessive” Europe’s probe into cheaper Chinese electric vehicles (EVs), and said China’s superior offering are the envy of other automakers.

European Commission President Ursula von der Leyen announced on Wednesday the investigation a week after executives at Munich’s IAA mobility show said European carmakers had a fight on their hands to produce lower-cost EVs and to close the gap on China’s lead in making cheaper, more consumer-friendly models.

Beijing has since blasted the investigation as a protectionist act aimed at shielding Europe’s own industry in the name of “fair competition”, and warned economic ties could be harmed.

“To tell the truth, when Chinese new energy vehicles shone brightly at the recent 2023 International Motor Show in Germany, we heard some envious and even jealous remarks but we didn’t expect Europe’s response to be so ‘excessive’,” the Global Times said in an editorial.

Analysts have warned that should the EU levy duties against Chinese EVs after the probe, which could take up to 13 months, China would likely impose countermeasures, hitting European industries.

“If Europe lacks the confidence and courage to win the market through fair competition, it will be impossible to establish competitiveness in the EV industry,” the newspaper wrote.
