The alleged gunman whom police officers in Brooklyn shot Tuesday night following a brazen street shootout was a parolee who never should have been out of jail, a prominent police official said.
Standing on Ocean and Church Avenues — not far from where spent shell casings littered the pavement — Assistant Chief Frank Giordano, commanding officer of Patrol Borough of Brooklyn South, confirmed that police immediately rushed to 533 Ocean Ave at around 7:30 p.m. on Aug. 12.
Cops arrived after two men got into a brazen firefight on the street that sent pedestrians fleeing for their lives.
“Our officers ran towards gunfire, and they bravely and immediately confronted a dangerous situation,” Giordano said. “When they heard gunshots and encountered two individuals involved in a shootout. The officers exited their car, they drew their weapons.”
While one of the gunmen took off running, police reported, the responding cops opened fire upon the other culprit, 22-year-old Edynesson Bauduy, striking him in the leg. He was rushed to Kings County Hospital and is expected to survive.
Police say they recovered a 9mm handgun at the scene.
Although Giordano commended the officers from the 70th Precinct for their actions, he also charged that the violence did not have to happen. He described Bauduy as a violent felon who was out on parole, though he had a long rap sheet dating back several years.
“He was arrested in 2021 at the age of 18 for shooting someone not far from where we are right now, and while that case was pending, he was subsequently released on his own recognizance from custody and arrested again for a violent commercial robbery in southern Brooklyn,” Giordano said.
Bauduy pled guilty to both crimes and received a concurrent sentence, according to Giordano; he was released from prison just two months ago, on June 10. The police official argued that the sentences should have run consecutively.
“If he received a consecutive sentence for his two distinct violent crimes, he would not be out on the streets right now involved in yet another shooting that endangers our public,” Giordano said. “This is a person who has repeatedly shrugged his shoulders at consequences and our criminal justice system.”
Charges against Bauduy for Tuesday night’s incident are still pending.
